Introduction
Stipulating a valid residential lease agreement in Italy requires attention to national and sometimes local rules. The main framework is the Codice Civile (artt. 1571 e ss.) and the Legge 9 dicembre 1998, n. 431, which governs residential lease contracts. The downloadable template in this article is prepared to comply with information obligations (including the APE — Attestato di Prestazione Energetica), the privacy rules of Regolamento (UE) 2016/679 (GDPR) and D.Lgs. 196/2003 (come modificato).
Compliance is not just a formality: missing or outdated clauses can invalidate rights of the landlord or the tenant, delay debt recovery procedures, or make it difficult to produce evidence in court. This template provides wording tailored for Italy, with fields to customize deposits, duration, rent and maintenance obligations.

Definition: What is a residential lease contract in Italy?
A residential lease contract (locazione ad uso abitativo) is the agreement between the owner (locatore) and the tenant (conduttore) whereby the owner grants use of a property for residential purposes in return for the payment of rent. It is governed by the Codice Civile (art. 1571 e ss.) and the Legge 9 dicembre 1998, n. 431, which defines types of contracts, protections and the conditions for termination and renewal.

Why old templates are dangerous (specific traps for Italy)
- Changed rules: legal references and APE or privacy obligations may have been changed or supplemented; using an outdated template can miss a mandatory notice.
- Null clauses: some clauses (e.g., waiving the tenant’s non-derogable rights provided by Legge 431/1998) are ineffective and can expose the landlord to liability.
- Security deposit: there is no mandatory national limit; the amount and return procedures must be clearly indicated to avoid civil disputes (art. 2946 c.c. for prescription terms of claims).
- Rent and increases: the law allows freedom to set the rent except for local agreements (canone concordato); increases must comply with any pacts and tax rules.
- Eviction procedures: expulsion for non-payment or other causes takes place through judicial proceedings (Legge 431/1998 and Codice di Procedura Civile); clauses that attempt to provide for extrajudicial enforcement are ineffective and risky.

How to Finalize Your Lease
- Fill in all details of the parties and the property. Make sure the cadastral description and the property identifiers are correct.
- Attach the APE and signed privacy notice: failure to deliver the APE may result in administrative penalties.
- Clearly define the security deposit and management method: indicate timing and criteria for deductions for any damages.
- Specify the form and terms for notice (following Legge 431/1998 for the cases provided) and the justified reasons for non-restoration.
- Have the contract signed in duplicate and register it with the Agenzia delle Entrate if the contract exceeds a total duration of 30 days or if the parties intend to comply with tax obligations (registration and cedolare secca where applicable).
- Before the final signature: upload the contract to an AI contract review tool for an automatic check and, if in doubt, consult a local legal professional.
Practical notes
- Registry: registration of the contract with the Agenzia delle Entrate is mandatory in cases provided by tax law. Consider the choice between ordinary registration and the cedolare secca regime, if applicable.
- Agreed rent: check whether the municipality of the property has joined territorial agreements that allow an agreed rent (with tax effects and limits) and adapt the contract.
- Eviction and dispossession: for non-payment or serious breaches the route is judicial; keep documentation (formal notices, registered mail, reports) to demonstrate attempts at conciliation.
Contacts and review
