Introduction
Ensuring that a residential lease agreement complies with Portuguese law is essential to avoid litigation, administrative fines and problems in recovering rents or deposits. This template was designed to align with the Código Civil, the Regime do Arrendamento Urbano (Lei n.º 6/2006) and data protection obligations (Regulation (EU) 2016/679 — RGPD e Lei n.º 58/2019). It includes the practical and mandatory clauses: identification of the parties, description of the property, term, rent, rent update, security deposit, inventory, required certificates and termination procedures.
Formal compliance and transparency protect landlord and tenant: clear clauses reduce disputes and facilitate judicial enforcement of evictions or collections when necessary.

What is a residential lease agreement in Portugal?
A written contract by which one of the parties (landlord) grants the other (tenant) the temporary use of a property for housing, in exchange for payment of rent, governed by the Código Civil and by the Regime do Arrendamento Urbano (Lei n.º 6/2006), with obligations of safety, habitability and data protection.

Why old templates are dangerous (pitfalls specific to Portugal)
- Rental legislation has been amended and supplemented: old templates may not reflect changes introduced by later measures nor current judicial practice.
- Security deposit: there is no mandatory national legal cap; templates that set rules inconsistent with the Código Civil or consumer protection rules may be unenforceable.
- Mandatory certificates: failure to provide the Energy Certificate (Certificado Energético) may prevent valid formal execution in certain circumstances and generate administrative sanctions.
- RGPD: old templates often do not include the mandatory information on the processing of personal data (articles 13–14 of the RGPD and Lei n.º 58/2019), nor clauses on consent when required.
- Rent updates: clauses that provide for automatic increases without legal reference or without an indexing clause tied to official indices (e.g. IPC/INE) may be contested.
- Eviction and termination periods: deadlines and procedures vary depending on the contractual regime (fixed-term contract vs. open-ended contract). Using a generic template may prevent proper exercise of the right of termination or defense in court.
What this template includes
- Full identification of the parties (name, NIF, address);
- Detailed description of the property and annexes (location, fraction, areas);
- Contract term: fixed-term and option for open-ended regime; renewal;
- Rent amount, payment date, payment method, charges and expenses;
- Annual rent update clause (optional, with index — IPC/INE — and formula);
- Security deposit: suggested amount (1–2 months); obligation to provide accounts and complementary return period (suggestion 30–60 days) and inventory of deductions;
- Inventory and condition report (mandatory annex to avoid disputes over damages);
- Maintenance and minor repairs obligations (tenant) vs. works and responsibilities of the landlord;
- Subletting and transfer of contractual position (landlord consent);
- Rights of inspection and necessary works (prior notice);
- Data protection clause (information to the data subject, legal basis and contacts — in accordance with the RGPD and Lei n.º 58/2019);
- Annex: Energy Certificate (mandatory when available) and proof of licensing/habitability when applicable;
- Termination procedures and rules for dispute resolution (mediation/competent court);
- Signatures, number of counterparts and acknowledgement of signatures (if applicable).

How to finalize your lease agreement
- Complete all mandatory fields (identification, NIF, property details, rent amount).
- Attach the Energy Certificate and the property inventory (dated photos recommended).
- Include the data protection notice (RGPD) explaining purposes, legal basis and retention period.
- Check the security deposit clause: amount, form of delivery, deadline and mechanism for return and justification of deductions.

- Have all parties sign in duplicate; each party should receive a copy. Consider notarial acknowledgment when necessary for evidentiary purposes.
