In Республике Казахстан, relations concerning the tenancy of residential premises are governed primarily by Гражданским кодексом Республики Казахстан and related regulations (including procedural and consumer law). Specifics: contractual terms on the security deposit and the amount of rent are generally determined by agreement of the parties, while the contract is subject to the general principles of good faith and the binding nature of obligations.

What is a residential lease agreement in Kazakhstan?

A residential lease agreement (residential tenancy agreement) is a written agreement between the owner (lessor) and the person obtaining the right to use the premises (lessee), establishing the term, the amount of rent, the procedure for transferring the premises, the conditions for repair and maintenance, the procedure for payment and return of a security deposit, and other essential terms. In the Republic of Kazakhstan such agreements are concluded on the basis of the provisions of the Civil Code of the Republic of Kazakhstan and are subject to performance and judicial protection in the manner established by procedural legislation.

How to Finalize Your Lease

1. Please fill in the parties' details in full: full name/company name, IIN/BIN, addresses and contact details.
2. Prepare a handover certificate containing a detailed inventory of the assets and a statement of the condition of the premises.
3. Agree on and set out the amount of the security deposit, the conditions for deductions, and the deadline for its return (recommended: 30 calendar days).
4. Establish clear cure periods for late payment and other breaches (e.g., 7–30 days depending on the nature of the breach).
5. Have the parties sign the agreement in the presence of two witnesses, or have it notarized at the parties' request (notarization is not always mandatory, but increases its evidentiary value).

Additional recommendations for compliance with the law

• Ensure compliance with Закона РК «О персональных данных»: notify the tenant of the purposes and legal grounds for processing, the retention periods, and the data subject's rights.

• For forcible eviction, a court order/decision in the manner prescribed by the Civil Procedure Code is required; self-help eviction is prohibited.
