Free Russia Residential Lease Agreement Template | 2026 Compliant - professional legal document template

Introduction

Compliance with local law when concluding a residential lease agreement (tenancy agreement) is critical to protecting the rights of both the landlord and the tenant. In Russia, tenancy relations are governed primarily by the Housing Code of the Russian Federation (Федеральный закон №188‑ФЗ от 29.12.2004) and the provisions of the Civil Code of the Russian Federation (Гражданского кодекса РФ). In addition, the processing of tenants' personal data is governed by Federal Law No.152‑FZ "On Personal Data" (Федеральный закон №152‑ФЗ «О персональных данных»), and consumer warranties may apply under the law on consumer protection (ФЗ №2300‑1).

This template is adapted to Russian requirements: it contains sections on the amount and return of the security deposit, payment procedures, the rights and obligations of the parties, notices and termination procedures, as well as a text for consent to the processing of personal data. Use the template as a starting point and refine it to reflect the specific conditions and local rules.

What is a residential lease agreement in Russia?

A residential lease agreement (lease of residential premises) is a civil law contract under which one party (the lessor or landlord) provides another party (the lessee or tenant) with residential premises for use as a dwelling for a specified term or for an unspecified term in exchange for payment. The legal regime for housing tenancy is established by Жилищным кодексом РФ (ФЗ‑188/2004) and the general rules of Гражданского кодекса РФ.

Why Old Templates Are Dangerous

  • Non‑compliance with Russian laws: templates from other countries (for example, the USA) often contain provisions incompatible with the Housing Code of the Russian Federation and the principles of civil law (for example, automatic eviction without court proceedings).
  • Incomplete or missing notices: in Russia eviction and forcible recovery of possession require judicial procedure (ЖК РФ), so relying on clauses that allow self-help eviction is dangerous.
  • Personal data: older forms often lack the mandatory consent for processing PD (ФЗ‑152), creating a risk of administrative liability.
  • Improper handling of the deposit: templates that do not account for the requirement of a detailed statement of deductions and a reasonable return period increase the risk of claims for unjust enrichment and disputes over damages.
  • No consideration of regional specifics: municipal or social housing funds are regulated differently; an old template may conflict with local rules.

What is included in this template?

  • Identification of the parties and information about the owner/authorized person
  • Subject of the agreement: description of the premises (address, area, characteristics)
  • Term of the agreement: fixed term or agreement for an indefinite term
  • Rent: amount, timing and method of payment, indexation (by agreement of the parties)
  • Security deposit: amount, storage conditions, requirement to provide a detailed list of deductions and the return period (recommended period — 30 calendar days, unless otherwise agreed)
  • Obligations of the parties: maintenance of the premises, routine and major repairs, utility payments
  • Notices and termination procedure: suggested typical notice periods (for example, 30 days' notice by the landlord for agreements of indefinite duration), requirement for written claims before going to court
  • Handover/acceptance procedure: an acceptance certificate with an inventory of defects
  • Consent to the processing of personal data (in accordance with ФЗ‑152)

  3. Consequences of registration/deregistration (propiska) — information on how the transfer of the premises affects registration actions.
  4. Information about municipal/regulated housing — when renting municipal housing or social housing, special regimes are disclosed.
