Free Chile Residential Lease Agreement Template | 2026 Compliant - professional legal document template

Introduction

Complying with Chilean regulations when entering into a residential lease reduces the risk of disputes and speeds up problem resolution (return of deposit, termination, eviction). In Chile, leases are governed mainly by the Código Civil (rules on leasing), and are complemented by consumer protection rules (Ley Nº 19.496) and personal data protection (Ley Nº 19.628). There is no national cap on deposits nor a national rent control regime, so the terms agreed between the parties are decisive, always within the framework of good faith and public order rules.

This article explains the key requirements, the risks of using old templates and how to use the downloadable template, and also recommends that you upload your final contract to an AI contract review tool for an automated verification of critical clauses.

What is a residential lease agreement in Chile?

A residential lease agreement is a written agreement between the Landlord and the Tenant whereby the former delivers a property for residential use for a specified period and price. In Chile they are regulated by the Código Civil (articles related to lease) and must comply with consumer protection rules and personal data processing rules when applicable.

Why Old Templates Are Dangerous

  1. Regulatory changes: old templates may not comply with Ley Nº 19.496 (consumer protection) nor the information obligations on personal data under Ley Nº 19.628.
    2. Poorly drafted deposits: without a history of return and itemization it is harder to mount a judicial defense; the template requires a record and detailed itemization.
    3. Rent increase clauses: in the absence of a national rent control rule, increases must be clearly agreed; old templates may leave room for dispute.
    4. Ignoring local or co-ownership regulations: municipal rules or condominium bylaws (reglamento de copropiedad) may impose additional restrictions.
    5. Eviction procedure: attempting to recover possession by force or extrajudicial measures may constitute a crime; recovery of possession must be sought through the courts (desahucio) according to the Código de Procedimiento Civil.
